NIGERIAN UNION JAPAN 2000
CONSTITUTION
Preamble
We the citizens of Nigeria, resident in Japan, gathered at this First General meeting, Conscious of the responsibility bestowed on us to portray our Fatherland in good light in this foreign land,
Determined to shield future generations of Nigerians in Japan from unhappiness brought about by the erroneous image of our country coupled with misunderstanding by our host and anxious to promote the well-being and progress of Nigerians in Japan,
(Desirous) to promote the good name, welfare, brotherhood and unity of our country and people,
RESOLVE to unite our efforts by constituting an association of all Nigerians resident in Japan upon the principles and byelaws contained within this Constitution.
Article I
1-1 To establish an association with the name Nigerian Union Japan (NU).
1-2 The Association shall have as its motto “For Unity”, as a testimony to its founding ideals,
Article II
The Organization/Association
1. The Association shall be non-political and shall cater for the welfare of its members, as well as serve as a forum or the promotion of Nigerian values and culture.
2. The medium of communication during meetings shall be English, the official language.
3. The registered address of the association shall be c/o The Embassy of Nigeria, Tokyo, Japan.
Article III
Membership
1. Membership is open to all Nigerians as defined in the Constitution of the federal Republic of Nigeria and as affirmed by residency in Japan.
2. A member of this Association must also he registered with the Embassy.
Article IV
Aims and Objectives
1. This Association has been founded as a facilitator for brotherliness, Friendliness and love amongst Nigerian.
2. It shall encourage harmony between Nigerians and their hosts.
3. It shall strive to protect the weak and needy Nigerians through constant support, in humanitarian ways and any other means that help to improve the disadvantaged ones while protecting those already successful.
4. It shall strive to discourage the demand for gratification in the rendering of services to fellow citizens (e.g. assistance to secure employment)
5. It will act as a communication bridge between Nigerians and the Nigerian Embassy in Japan on any issue brought to its attention.
6. It will constantly inform Nigerians on Issues that have both negative and positive effects on the national image.
7. It shall assist all Nigerians who may be in distress,
Article V
Organizational Structure/Election
The association shall have the following officials, most of whom will be elected
1. President
- Shall be the Chief Executive of the Union
- Shall preside over all EXCO and General meetings of the Union
- Shall speak for the Union with the mandate of the EXCO/General Assembly
- Shall be a signatory to the Union's financial transactions and Bank Accounts
- Shall approve all payments together with the Financial Secretary after due approval from the general assembly
- Shall mandate the General Secretary to call meetings in consultation with his EXCO members
- Shall visit at least one zone of the Union in every two months other than Tokyo to see the members.
The President shall serve as the Chief Executive Officer of the Union. He/She shall supervise the overall operations of the Union and shall represent it in all official functions to which the Union is invited or required. He shall submit a report to every meeting of the General Assembly. He can direct any member of his/her EXCO to act for him/her in his/her inability to perform a function.
2. Secretary General - He shall coordinate the activities
of the Association including
proper keeping of the records.
3. Zonal Assistant Secretaries - To assist the Sec-Gen in the
General coordination of the activities of
the association in their zones.
4. Financial Secretary - To mobilize funds/disburse, But
must hand over such funds to the
treasurer within forty-eight hours
of collection.
- Coordinates and manages the funds
of the Association.
Presents financial Report for auditing
every quarter-during meetings.
- presents annual/quarterly budget
of the Association
- shall be a signatory to the
association's bank account.
5. Assistant Financial Secretary - To assist the Financial Secretary
6. Treasurer - To keep the association's purse
shall keep all monies for the
Association in the
Association's account which
- Shall be kept by the Embassy.
7. Assistant-Treasurer - To assist the Treasurer
8. Welfare Secretary - To Minister to those in distress
9. Assistant-Welfare Secretary - To assist the Welfare Secretary
10. Legal Secretary - To advise on matters of
legality/keep the seal of the
Association.
11. Assistant Legal Secretary - To assist Legal Secretary
12. Public Relations Officer - To publicize meetings/publish
journal
13. Assistant Public Relations - To assist Public Relations
Officer Officer
14. The consultative Assembly - The meeting of the General
Assembly.
15.There shall be an auditor who shall be externally appointed to audit the books of the Association once a year or when the need arises.
Tenure:- The tenure of office shall be one year in the first instance and not more than one more year in the case of re-election.
Eligibility to vote for /or be voted for
1. A voter must be registered with the Association to be eligible.
2. A voter must have paid all dues to date.
3. A voter must have attended at least 60% of all meetings from date of his/her registration while those who have not attended up to three meetings after registration are automatically disqualified from voting or being voted for.
Disqualification:- A candidate seeking elective post shall be disqualified for the following reasons.
1. Ungentlemanly conduct (public fighting, spousal abuse etc)
2. Vote buying
3. Slanderous campaign against opponents (e.g.backbiting etc)
4. Any other offence as may be determined by the electoral body
Removal from office - The following shall provide grounds for removal from office.
1. Non-performance
2. Unauthorized conversion of Association's property to personal use.
3. Embarrassment to the Association
4. Criminal record
Methods for removal from office - An office holder can be removed front office as follows:
I. A call for removal from office by a member and/or resignation after due investigation.
2. The Executive Council passes a vote of no confidence.
3. The General Assembly passes a vote of no confidence.
4. Any removal shall require 2/3 majority of votes to be valid.
Filling empty position/offices:
An election to fill a vacant position shall be held during a general
meeting following the one in which the position was declared vacant.
2. In cases where the vacant position has an assistant, he or she shall continue to act till the election is held.
3. Where an officer changes residence from Japan to another country, his/her position shall be filled as in 1 and 2 above.
Method of election
Candidates for elective offices shall be nominated by a member of the Association and such nomination shall be supported by another.
2. Nominated candidates shall accept such nomination in writing to the returning officer not later than one week before the election date.
3. Elections shall be on the floor of the house by open/secret ballot.
A simple majority of votes cast shall determine the winner.
Article VI
Board of trustees
There shall be a board of trustees for the Union, which shall compose of:
a.) The Patron of the Union who is The Head of the Nigerian Mission in Japan
b.) The President of the Union
c.) Four other members, who shall be persons of proven integrity, experienced leaders of Unions and generally respected by all and sundry.
1. The four members shall be nominated and ratified by the General Assembly. The Trustees shall hold Offices for Two (2) Years.
2. Members of the Board of Trustees shall fashion out policies that shall give the Union the relevant direction needed to meet its aims and objectives.
They shall constitute the council of elders (without prejudice to age) and shall have no legislative powers. They shall serve as arbitrators in all matters and ensure the continued unity in membership.
They shall not seek elective positions.
Article VII
Meetings -
1. There shall be a general meeting of the Association four times a year, that is every quarter.
2. Emergency Meetings shall be called as at when due.
3. The Executive Council shall meet at least once a month.
Article VIII
Welfare
The Association shall extend a helping hand to members in need.
2. Help in securing employment through a network of members who have vacancies in their place of work.
3. In times of sickness, help in ways to be determined by the nature of illness and the general body of the Association.
4. Shall come to the aid of members that have immigration difficulties in ways that are possible.
5. Shall come to the aid of members facing oppression or victimization in his/her place of work.
6. Shall help to protect members from overzealous or privileged ones.
7. Shall in the case of death of a member assist in possible ways of giving a befitting burial.
8. Shall go on condolence visits to members that lose loved ones arid render any other assistance.
9. Shall give financial assistance to be determined on merit from time to time to needy members.
10. The above provision shall be applicable to members who are active financially.
11. Nothing in the above provisions entitles a member who willfully commits or engages in criminal activity, to any assistance from tine association.
12. Any other area as deemed fit by the general body of the Association.
Article IX
Discipline
1. Discipline shall be the watchword of all members at all times.
2. Members shall conduct themselves with decorum at all times.
3. Members shall he liable to disciplinary action if persistently found to
be out of order.
4. Members shall always uphold the integrity of the Association.
Article X
Dues and Fines
1. Members shall pay twelve thousand yen annual dues en bloc or in two installments within the first half of every financial year.
2. Members who misbehave shall be liable to a fine to be determined by the Executive Council depending on the gravity of the offence.
Article XI
Amendments/Suspension
1. Parts of this constitution can be amended in writing from a member to the General body over complaints or observation on any article that had become obsolete or objectionable.
2. Deliberation on the part(s) to be amended/suspended shall be at the next general meeting following the one at which the motion to amend or suspend was raised.
3. Two thirds majority of votes shall be required for amendments or suspension of parts of this constitution.
Addendum
This constitution is not subject to interpretation in any court of law.
